An attorney representing the family of a Bakersfield attorney who died while running a 5K during a heat wave says they’ve obtained “powerful new evidence” against the running club that hosted the race.

A wrongful death lawsuit was filed against the Bakersfield Track Club by Michelle Greene — the widow of Benjamin Greene.

Benjamin Greene was a defense lawyer who died during a run at Hart Park in June 2017.

Attorney Eric Dubin didn’t elaborate on what kind of evidence it was, but said they look forward to a jury trial next September.
