The Kern County District Attorney’s Office will announce Wednesday whether or not charges will be filed against ICE agents for lying to investigators following a crash that killed a couple fleeing them last month.

Delano Police Department says ICE agents lied about what happened during the chase that killed Santos Hilario Garcia and Marcelina Garcia Profecto as they fled from federal agents on March 13 on West Cecil Avenue.

The couple initially stopped, but the couple took off as ICE agents got out of an unmarked vehicle.

According to Delano police, deportation officers Ramiro Sanchez and Dimas Benitez said they continued in the same direction for 15 seconds, pulled over and eventually continued westbound, but were not pursuing the couple.

Delano police said surveillance video contradicts the deportation officers statements.

Delano police are requesting charges be filed against the agents for giving false information.

The District Attorney’s Office will announce its decision at a press conference Wednesday morning in Bakersfield.
