A Sacramento television station reported that state Senator Roy Ashburn was seen at a gay nightclub before his early Wednesday morning arrest on suspicion of drunk driving in Sacramento.  The television station did not name their source.

According to a KGET poll, the senator's sexual orientation is of concern to some of his constituents, since he has strongly opposed gay-rights legislation.  Ashburn has repeatedly opposed legislation that would enhance gay rights, such as recognizing same sex marriage.

Mike Johnston, the chief financial officer of Faces Nightclub would not confirm if the senator was spotted there.  "We had a management meeting with the management staff and none of the managers saw him and none of the staff we spoke with saw him. We can't confirm he was here, we can't confirm it," Johnston said.

Johnston also told 17 News the nightclub is very big, with five rooms and three dance floors.  He said on Tuesday night, the night in question, they were holding a "Miss Gay Latina Sacramento" contest, with more than 400 people inside.  But Johnston says they never disclose who their clients are, unless it's a legal matter.  "This is a private business and people who come in here are entitled to enjoy their privacy," he said.

17 News spoke with people on both sides of the political spectrum about the reports.  Alex Neal is openly gay, and used to own a Bakersfield gay bar.  "I don't pay much attention to personality or personal life of each politician. I usually look at their views, their stances on political matters," Neal said.

Mike Ludwig, a republican from Bakersfield, doesn't give the report much credit.  "It hasn't been confirmed yet, it's all speculative. It's not true until it's been proved. I really don't think it matters one way or the other," Ludwig said.

A Sacramento district attorney reports Ashburn's blood alcohol level was .14 when he was arrested.  We called the senator's cell phone and left a message. He did not return our calls.  Ashburn was a no-show Thursday on the senate floor.

This is very disappointing for Bakersfield! Roy is not about the punishment.. Its the fact that we trusted you, we relied on you... we heard your voice, we stood on your side, we cheered for you, we supported you, we didn't doubt you, we gave you our voice for others to hear... This may not effect Bakersfield directly, but i assure you it does indirectly..

To those people that say its not about what his sexuality, but about his beliefs and his political view. Well, I disagree with you, because his belief, his political view, his actions, just proved to you that he doesn't stick with what he says. In other words he talks the talk, but then is a hypocrite. I wonder what he will say in the next few days, I can't wait. Maybe he is ought to hurt himself as stated by Murphy1951, but I guess we have to wait and see what he and his team come up with to tell the public!

This doesn't come as a huge surprise to the Bakersfield community. He was living two lives while married...for many years. I feel bad for his family. This seems to all be coming out, and who's he really hurting? Not that I condone divorce, but at least his wife (or kids)isn't sitting home wondering why he alledgely came out of the club. He's been visiting underground clubs in town for many many many years. Ask any male and openly gay hair stylist in town. lol Hopefully he will come out, and then continue to support Bakersfield in a positive matter...whether in politics or not. The issue isn't being gay or straight...it's portraying one thing and really being another. Be true to yourself.

Maybe Roy wants to be a Kibler Elve and is learning about fudge packing?

WySSOne: "Behind him" and "Reach around?" Hehe, that's great. This is proof again to be suspect of the most outspoken anti-gay people - they're usually the ones leading a secret double life. I've seen it again and again for 30 years. There's nothing wrong with being gay, but when you target gay people as a "non-gay," that's the worst kind of hypocrisy there is. God knows gay people go through enough to have to deal with another bigoted closeted politician.

This sounds WAY too much like a political set up. Its no secret that he has plenty on political rivals within his own party and that the climate was getting downright nasty. If this was, in fact, a set up, I would say this is an all time low. But it goes to show you, never cross the cross the political Grand Pappies in the GOP, or else! Fall in line, or we will ruin your career! Danny Gilmore saw how it is, and wisely decided he wanted no part in it.

Just another "Lord of Bakersfield," I bet he wants to put this whole situation behind him. And reach around to embrace the future. There will hopefully be a happy ending for everyone. But in fact, it might leave a bad taste in someone's mouth.

It does matter if he is gay or not as it is the persons beliefs and character that we use to decide who to vote for. The public elects people who have similar morals and beliefs as they do so the chances are better that the political actions they take will align with the voters. If someone is operating under false pretenses then there is definitely a problem there. And just like tiger, you can't condition that your fame only encompass the positive atributes of your life. When people are famous they are subject to the public spotlight and there simply is no filter for the negative. You can wish there was all you wont but it simply isn't going to happen.
