UPDATE: Police say no charges in death of bullied 13-year-old

Seth Walsh, the Tehachapi 13-year-old who hanged himself from a tree in his back yard after years of being bullied, died Tuesday afternoon after nine days on life support.

Tehachapi police investigators interviewed some of the young people who taunted Seth the day he hanged himself and determined despite the tragic outcome of their ridicule, their actions do not constitute a crime.

"Several of the kids that we talked to broke down into tears," Jeff Kermode, Tehachapi Police Chief, said. "They had never expected an outcome such as this."

He said the students told investigators they wish they had put a stop to the bullying and not participated in it.

Friends said Seth was picked on for years because he was gay. 

School administrators said they have an anti-bullying program in place, but schoolmates said staff at Jacobsen Middle School in Tehachapi offered Seth no protection or guidance.

A YouTube video by a family member sends a message about Seth: "He was bullied and teased, now in the hospital, this face right here is suffering because of bullying, never say a mean thing again."

Meanwhile the community is pulling together for the Walsh family. A fund has been set up at Bank of the Sierra for donations. In Bakersfield, Audrey's Cafe on Union Avenue at Truxtun Avenue has a box where people can send messages to the family to show their support.

"We decided that we as a community in Bakersfield and as a county needed to do something to show our support," said Kathi Briefer-Gose, a gay rights activist. "People can bring down cards, letters, to tell the Walsh family that they are behind them."

A memorial service for Seth will be held Friday at 3:30 p.m. at First Baptist Church in Tehachapi.

This was a tragic story but the problem of bullying will not be solved by taking the issue to the courts. The only thing that will work is education. Until that happens this will continue.

OMG, shut up you ignorant people blaming the parents. As for the schools comments, Ive had 3 of my kids go through school in Tehachapi, including my 11 year old daughter that goes to Jacobsen, shes about the sweetest girl Ive ever known, and loves everyone. But, to listen to her talk about her teachers, its sad!Miss Cookie, she hates her and has been telling me how mean she is for years. Come on teachers, you might think us parents dont know, BUT we do! God rest your soul Seth

I was bullied all though school until high school. (Not for being Gay) It effects you for the rest of your life. I have no self confidence, and continue to stay to myself and not make friends. I no longer blame the students for what happened to me 40 years ago. I blame the system for not telling me how to "react" to the taunting. If you react like you are hurt, kids act like a pack of wolves.

How is it that school officials claim they can' t control out-of-school-hours behavior when it comes to anti-gay bullying, yet they will often try to test students for drugs consumed during out-of-school hours, and kick students who test postive out of extra-curricular activities? Or students who post negative comments on personal blogs about school officials or teachers during out-of-school hours? You can bet that if a student started posting comparable remarks about specific school administrators or a teacher, the administration would get involved. Only when it is violence and bullying against gay students do they claim their hands are tied.

Based on a friend's information which came from a person who works in the Jacobsen Middle School's administration office, Kaminski & Ortega had a system to avoiding Wendy Walsh's phone calls about the bullying that went on in school. Wendy took Seth out of school 2 weeks after it started this year because the bullying did not stop. Swanson advised both Kaminski and Ortega not to attend the memorial. I hope this goes somewhere. I hope that person has the courage to step forward and blow the whistle rather than just mention it to friends and family members... because this is just wrong... Godspeed Seth.. Your spirit lives on in the lives of those you touched.... Each will take a part of you with them and it will touch the lives others who will never meet you in this lifetime.

the Tehachapi schools will not help you if you need help. they are very bad schools. most of the teachers hate you. if you dont belive me go there. i hate this place and most of the people here. if mr.t were still here he whould have done somthing. no BUT HE ISNT YOU KNOW WHY THE TEACHERS GOT RED OF HIM. NO crime was commited? Under California statute this should be prosecuted. Here is the law that is rendered and should be followed. If nothing else the school district is at fault and should be charged. Article 3. School Safety Cadre SEC. 7. Section 32290 of the Education Code is amended and renumbered to read: 32270. (a) The partnership shall establish a statewide school safety cadre for the purpose of facilitating interagency coordination and collaboration among school districts, county offices of education, youthserving agencies, allied agencies, community-based organizations, and law enforcement agencies to improve school attendance, encourage good citizenship, and to reduce school violence, school crime, including hate crimes, vandalism, drug and alcohol abuse, gang membership and gang violence, truancy rates, bullying, teen relationship violence, and discrimination and harassment, including, but not limited to, sexual harassment.

My 13 year old has been bullied and when it happens my husband and I call the school, send emails, speak with the principal... we do what we need to do! What did the parents do to help their child before he committed suicide???
