The legal slugfest over sludge is headed to the California Supreme Court.
In a unanimous vote and in closed session Tuesday, county supervisors moved to petition the court to review the case against Measure E.
That request comes after an appellate court ruled Kern County was unlikely to win in a lawsuit filed by Los Angeles over the county's 2006 ban on imported sewage sludge.
That ruling came after the county challenged a Tulare County superior court decision prohibiting Kern from enforcing Measure E.
Sludge generators in the southland say Kern has no legal authority to ban the spreading of their biosolids on farmland here in the county.
