Parents sue KHSD claiming their autistic daughter was raped at school

Parents of an autistic child claim their daughter suffered emotional damage after being raped at school but the lawyer for the school district says he has experts that can say that's not the case.

I just heard that they want to put a gag order on the parents of this child and their attorney!!! What is the KHSD trying to hide???? Smells like a Cover up to me!

I am a parent of an Autistic son, two things here, regardless of their mental capacity there testosterones evolve just like any other boy.....having said that why would the High School have "co-ed" bathroom for "special needs" kids? Were the bathrooms for the regular kids co-ed? NO! This kind of stuff just iritates the heck out of me, these kids aren't DUMB! At this point whoever thought co-ed bathrooms were acceptable is the DUMB one!

After trying to find out more about this incedent I have more questions...What is a "crime"? Would it be a report from a teacher going into a bathroom because of hearning screams and seeing with his own eyes, a boy holding a girl by the hips, both have there pants down with his privates up agaist her buttocks,and she's screaming, (A follow up news paper artical stated) by law what is that called?... Rape?, sexual assult? Are thoses not crimes? What is it called when no call to parents were made until after 5 hours of an assult, (mind you not "allaged assult" because remember it was wittnessed)is that called failure to report? Are not school employees mandated reporters? Do schools not have portocals? or was nothing done because the child was austic? Do healthcare "profesionals" know that there are "laws" that may pervent an arrest because of mental status? it dose NOT that mean that there was "NO" crime committed. What's so horrible is the effect of all that was "allowed" to happen to an innocent child that should have been safe. Makes me wonder how many other times the school district has covered up. Special education students have a voice it's their parents and should be there teachers. They also have feeling, eat, sleep, laugh,live and communicate in there own way. The students trust there teachers, are dependant on there help. WOW! I cant imagine how lost, afraid, scared this child was....

This article has NOTHING to do with mainstreaming - these kids were segregated into a special day class. This story reveals the district's utter and heart-breaking disregard for their special needs students. It's ludicrous to say that rape doesn't matter ("no negative effect") when it happens to a girl with autism. This girl has the intellectual ability of a 4 year old - doesn't a 4 year old feel pain, terror and confusion when attacked? School districts call the police to report fights on campus and to tell parents to pick up their kids when they talk back rudely to teachers, but not when they are raped? Is there any teacher or administrator who wouldn't be absolutely out of their minds with rage if this had happened to their 16-year-old daughter and they weren’t called immediately? The teachers, aide and staff spent five hours after the attack consulting with an attorney and collaborating on getting their story straight because that was more important to them than notifying the parents so the girl could both get a physical exam AND most importantly, be delivered directly into her parents' loving arms for reassurance. It’s so insulting for anyone to say these parents are suing the district only to benefit from what happened. The district has demonstrated they DON’T CARE about these kids and unless they feel the financial pressure to provide adequate and appropriate support to these kids, they will keep on doing the SAME THING. This boy was ENABLED by staff to attack this girl. District administrators need to reminded that they will be punished financially when they fail to fulfill their moral and ethical duties to vulnerable and fragile students with special needs. I wish they had a sense of humanity – then this never would have happened. District administrators can only blame themselves.

Someone needs to be loosing jobs. if this is what they can say about this poor girl. They are rapist too. How dare you say that. Makes me sick to read what I just read. That boy needs to be locked up. And rape is a crime. And anyone there should be punished. This can mentally damage this girl forever. And to think they act like this was nothing, including the police. What if she had caught something or got pregnant. You cannot chose what is ok for this girl or what happens to her. That's why all these people including the school officials that handled this matter should be charged with neglect. And helping a rapist. Shame on you people. And to not let the parents know are you kidding me. They should never be able to work around or for children again.

For all you people who can sit there and criticize and past judgement. Shame on you. Do any of you have a special needs child? Do any of you have compassion? If this where your child, what actions would you take? I for one have worked with special kids children and we are to protect them. They are various types of needs that need to be met. Not all children can fend for themselves. I believe in this particular case that I am reading is very sad. I feel for the parents and for their daughter. And as for special needs children attending a public school. Where would you like children to attend to school? These children deserve the very best in life. They did not choose to be born the way they were. Shoot, none of us did. So because they need special attendition they should not be in a public school? Well I think people who think like your self should be educated before you express your opinion. I pray that is case will open the eyes of the public and the school district and do something about their protocol. If that we're my daughter and I was notified that late in the day. As what these parents were, Lord knows I would be in front of the news exploiting the school. Every child has a right. Why was this young lady not given hers? If this were a normal functioning young lady, I wonder what the school would have done then. Hmmmm..... Very disappointed to here this. May The Lord comfort this young lady and may justice prevail.

Sounds like there may have been intercourse bu who has the samples & what was done with them?

I know the parents of this innocent child, and they are speaking for those who cannot speak for themselves! Autistic children are to often targets and victims of predators and teachers that just don't care! Look up how many disabled children have been victimized in Bakersfield alone! Many people don't like reading about these issues. As far as the police go, they report what they feel like reporting, just to clear their case load. Im sure the truth will come out! and I pray that those who did not do their job get justice. And as far a KHSD goes they cover up issues every day, Shame on them!! Shame!
