On Tuesday, a federal appeals court ruled California's same-sex marriage ban is unconstitutional. Now, the battle over the voter-approved law may be headed to the U.S. Supreme Court.

This hot button issue always draws passionate opinions. While the legal process if far from over, Prop. 8 opponents feel victorious.

As President of the Bakersfield College Gay Straight Association, Matt Gunther is feeling pretty good about the decision. "This is a stepping stone for society to accept gays and lesbians and other groups as full members of society."

Gunther was pleased to hear a three judge panel of the 9th U.S. Circuit Court of Appeals ruled 2 to 1 that California's gay marriage ban is unconstitutional. The case could head to the U.S. Supreme Court for the justices to decide.

Gunther says, "This means one day I can get married to somebody that I am in love with, so that's good."

The court says gay marriages cannot resume in California until the deadline passes for Proposition 8 supporters to appeal to a larger panel on the 9th circuit. If such an appeal is filed, gay marriages will remain on hold until it's resolved.

Ken Mettler is the former Chairman of the 2009 'Yes on Proposition 8' campaign. Mettler would like to see traditional marriage upheld. "I hope that there may be some sanity with the 9th circuit and they would, as a body, as the 11, would put an end to this nonsense, however it will probably go the Supreme Court. I have more confidence in the Supreme Court than I have in the 9th circuit."

Mettler adds the majority of Californians made their voices known by approving Prop. 8. Opponents have 60 days to file a petition to the Supreme Court, and the justices can decide to hear the case or leave the issue in the state's hands.

@ The Dude- I do NOT wish to see a homosexual couple making out in public nor do I wish to see a heterosexual couple making out in public. That is a private moment that should be respected and kept behind closed doors for any couple gay or straight. Furthermore,Im tired of them and the people who support prop8 demanding equality & throwing it in everyones face, who is against it, that they should have a right to make the choice to be married.FINE! But I have a soon to be one year old and I SHOULD HAVE A CHOICE IN WHAT IS BEING TOUGHT TO HIM IN SCHOOL!RIGHT? I think the only reason it will be passed is for the extra money its gonna make w all these homosexuals getting married then divorced in 2mos.And YES,I have several gay friends and they know my personal opinion...

Ken Mettler needs to stay out of other people's bedrooms. He doesn't belong there.

Wow, not only is Bakersfield full of racists, but homophobes as well. I have never seen a gay person "acting like some porn flick" in public (though i have seen straight couples act pretty pornish.) Nothing is being forced on anybody, all these people want is to be treated as equals. All of you people who hate gays (for no reason i might add) probably have one in your own family, but they are too terrified to come out because of your hateful comments. I don't see how it's anybodys business who marries who, is it really going to make a difference in your life? I highly doubt it. What are you people afraid of anyways? That your kids might learn tolerance? That they may grow up to be open minded, accepting, respectful? They aren't gonna "turn gay" if that's what you're afraid of. If they do come out, it's because they were gay already and finally found the courage to come out.

ok granny and jign4bass what exactly is being forced upon you? a group of people wanting to be treated as equals? do either of you personally know a gay person or are you going by what you hear in the media? how quickly you assume and generalize an entire group of people based on what exactly? what exactly is "the gay lifestyle"? i am straight and my life style is probably much different than other heterosexuals. i know its a scary thought but sometimes the majority of people or wrong, thats is why we have a constitution isnt? living in bakersfield i have met many people that seem very comfortable being racists, bigots, sexist, and hateful, but i dont assume thats how everyone is. why would i? seriously, labeling entire groups of people based solely on how you feel. how is that in any way an appropriate way to raise children? wether you find something wrong or not is not the issue its about the civil rights, to be treated as equals and thats why people get so mad. you dont view gay relationships as equal worthy of acknowledgement despite the fact that heterosexuals have done nothing to show their superiority other than a 50% divorce rate.

The people of California spoke on the issue, twice. It is clear that the majority do not want gay marriage and uphold that marriage between a man and a woman. The homosexual judge clearly had an agenda on this matter. The gay community is an in your face bunch. They want to push their agenda and have that in your face attitude. Quite frankly I really don't care what one wants to do in their own bedroom. Just keep your abnormal agenda out of my faces of the majority that disagree.

The gay community are a bunch of bullies, forcing all citizens to accept their life style as a normal human relationship which it is not. They are forcing it upon our children having them as a captive audiance in schools! They are trying to force it upon us but it will never work. The more they flaunt their repulsive and unhealthy life style the more people will resent them! It is time we get a recall going on those judges! Seems San Francisco breeds judges like them like rabbits multiply!
