Husband won't be charged in wife's shooting death

New developments in the shooting death of a Bakersfield woman, Beverly Ziros.
 
On Tuesday, the District Attorney's office said it will not file charges against her husband, Andrew Ziros.
 
Police found the 66-year-old woman shot to death in her northwest Bakersfield home last month.
 
A hospice worker found Beverly shot, with Mr. Ziros sitting next to her with a gun.

Prosecutors say there is no doubt in their minds Andrew Ziros shot and killed his wife. However, they believe Mr. Ziros truly didn't know what he was doing.

"What's the likely outcome and what's the right thing to do in a case where we honestly believe that he was hallucinating at the time? And, again it's just extremely horrific, the entire incident is," said Andrea Kohler, Supervising Deputy District Attorney.

Andrew Ziros has terminal cancer and is in a care facility. Prosecutors say he is no threat to anyone there.

How did he have access to a loaded gun? In his "delusion" Was he able to locate the gun, and amo, load it, and use it? Did his wife load it and give it to him? As far as wasting our tax dollars, I've seem them waste more and get less. Use a gun-go to jail. I'm very sure many, many people right here in Bakersfield have shot and killed others while being "delusional" but they are just fine now. It comes and goes right?

The man has terminal brain cancer and is under hospice care. Brain damage of any sort can have serious consequences to a person's ability to see, hear, smell, feel, think rationally...the list goes on and on. The delusions experienced by someone in that state are very real to them. As an acquaintance of the family, the entire situation is tragic. It is comforting to know that Mr. Ziros' last days will be in hospice care, not in a court room.

i agree with this...go after REAL criminals that affect everyday life of law abiding citezens, why waste tax dollars and court time on this.

he was enough with it in his head to lock & load & fire a pistol till it was empty...... but then again this is the land of dismissing felony charges & murder isn't it.
