Couple wins landmark trial against medical company

Legal and medical professionals from across the country are paying very close attention to a groundbreaking verdict that happened in Bakersfield.

For the first time in the nation, a jury has awarded a local couple $5.5 million against the maker of a medical implant, claiming they knew their product was unsafe.

Christine Scott got the official news Monday morning at Kern County Superior Courthouse. She had a vaginal mesh surgically implanted and has had complications ever since. She and her husband sued the maker and won, making it the first victory of its kind in the nation.

"I was like 'Thank you, God.' We can finally get the word out to women," said Scott after the verdict.

After some four years of legal battles and court-ordered silence with the maker of the Avaulta Mesh, C.R. Bard Medical, Scott gets some relief from the victory. An active runner, Scott got the implant to correct a leaky bladder. But, the device began cutting her colon, and tissue continues to grow through the tiny holes in the mesh. She had already had eight surgeries when we first met Scott last month.

"I don't know if I'll have ten surgeries now. I don't know if I'll have one. I don't know if I'll have 100. The doctors cannot tell me," Scott said in June.

A jury awarded Scott $5 million and her husband $500,000, claiming the mesh has ruined their love life. It's a landmark victory, the first of its kind in the country.

The Securities and Exchange Commission indicates 47,000 women have had the mesh implanted, and 650 lawsuits are pending.

"In fact, this case, they advertised it as FDA-approved. It's not. It's a crime," said Gene Lorenz, a lawyer representing Scott.

The lawyer for C.R. Bard Medical says the company stopped selling the Avaulta Mesh on July 1, 2012 in the United States because the FDA wanted more clinical trials done. But, it's still sold in other countries.

"This is a product that has been cleared for use by the FDA and can be safe and effective when used properly and for the right patient," said Michael Brown, attorney for C.R. Bard Medical.

"They tested this on 16 rats, 12 rabbits, four sheep and, by their own researcher's admission, the next living being this product went into was women," said Elaine Houghton, Scott's attorney.

Scott says she will continue to deal with complications from the mesh, while being a voice for other women.

"The hardest part, I will tell you, through this whole thing, is having to keep quiet, watching women still get hurt. But, I was legally not able to get out there and tell and that, I'm sorry," said Scott holding back tears. "And, that every day I was like please be over so I can talk. So, when I got that verdict it was like 'Thank you God.' Now we can do something."

There will likely be an appeal in the case, but Scott says she's just happy to no longer have the court-ordered silence, so she can talk about it. She wants to start a support group for women. And, her lawyers are working on a website for people wanting to know more about mesh implants. They hope to have that up and running by Monday.

The scary thing is this is just one woman. There are thousands of people who have been affected and I'm sure there will be plenty more who come forward with the same problems as long as the companies continue to sell these devices. I was reading a www.transvaginalmeshlawsuitlawyer.com and was surprised at how many different companies are selling mesh! Obviously those attorneys know what they are talking about since it looks like the specialize in these cases.

I am so happy that she won..the money couldn't pay for all the pain and suffering her and her family went threw but I think its justice is what matters...so the manufacture of mesh can know what terrible device that was and how it ruened thousands of women's life....I am one of them 2 yrs ago I had that terrible device implanted and been suffering since... I had two corrective surgeries my uterus tooken out and goin under another corrective surgery next month I am terrified....I am only 31 yrs old I was 29 yrs old when this all started....I was a medical nurse for 7 yrs and now I am on disability cause I can no longer sit or stand too long ..I have permanent nerve damage to my left leg from where they attached the mesh arm...chronic pelvic pain...painful bowlmovents, painful intercourse ...bladder problem ...I have two children and a husband who have been threw a lot with me...I am so happy for the couple who won and I hope everything turns out okay for her ...this device is disgusting and I pray that every women is awarded for everything they deserve and wish them the best...... Mesh victim...

I disagree with all the people who are criticizing her for this lawsuit. Think about her situation-she got this mesh to fix an embarrassing problem but instead of getting treatment she lost her sex life, went through surgery and endured a million other complications. I guess only a few comments posted at a time, I made post ealier to "user" that said Ms. Scott meant to say " we are getting paid" and not "I have a voice", to insinuate that financial gain was motive behind filing claim, that is very unfair. People are hurt every day by the actions of others. Same type of devices recalled in 1999 and lawsuits settled "quitely", yet here we are again. Almost identical devices, causing almost identical injuries. How is this even allowed in this country? How about sales stopped in US as of July1, 2012, however Bard will sell device in other countries? Why? Are those women LESS human? Do their lives hold smaller Value? Come on manufactures, you know what harm they cause, and rather American, Latino, Spanish, French, Europeon, these are HUMAN BEINGS. They deserve SAFE medical devices. I say lets start CRIMINAL Charges, Send executives to jail, or better yet maybe they should these devices implanted in their bodys. I bet we get SAFE PRODUCTS THEN. Until we rise up as a society and demand better, we will always GET LESS. I am a victim of mesh myself. It has ruined my life and I am only 39. Many surgeries, and mounting medical bills later , I am worst now than original day of 1st surgery. Did I bring this harm to myself, NO. If the discussion was a person injured by a DUI driver, there would be NO question of liabilty, and whom should be accountable . Yet these victims are in the same position, Blind sided by that drunk driver that ran the red light causing their injuries. Did they know a risk came with driving "of course" did they expect to be T boned by a Drunk driver, NO. Same here. yes every surgery holds a risk, however did these patients know a time bomb was being implanted? That answer is NO. The whole system needs an over haul. Make safe products, you will have less risk of liability. Until then, this will continue to repeat. 1999 758 pelvic mesh cases setlled. 2012 ??? Thousands. See the cycle.

I have been doing some research daily on this transvaginal mesh and since I've been educated more about this product, there are several hundreds of women having complications from this product. This product has been taken off the market and wasn't FDA approved. It doesn't make sense how these medical companies can provide a product to the medical industry and not take the proper measures of using these products in humans. This particular product was never tested in humans, but was tested in animals. But then these companies want them inserted into humans. Where is the moral from these companies? How do they sleep at night facing these demons that they are doing wrong to these people. As for Christine Scott this woman has been in my prayers daily and I'm estatic that justice was be served for her. I hope this landmark case sets the bar for all the other cases across the country and world. I hope her story will be told and help save the other women out there who have no more hope left.
