Coroner: Boy who died, not sexually assaulted

Emergency room doctors at Kern Medical Center initially told detectives that 2-year-old Guillermo Alvarez had injuries to his rectum and genitals consistent with a sexual assault.

That's according to a search warrant obtained by 17 News on Wednesday.  The detectives say the boy also had bruising to his face, chest and back, and internal bleeding and brain damage.  Twenty-nine-year-old Josh Preston is the live-in boyfriend of the boy's mother and is charged with first degree murder and cruelty to a child in the boy's death.

But following an autopsy, he has not been charged with sexual assault. "The medical staff saw some signs that were consistent with a sexual assault what happens is the coroner conducts an autopsy and determines they were not so no charges were filed," said Sr. Deputy Michael Whorf of the Kern County Sheriff's Department. 

Deputy Coroner John Van Renselaer says it's possible the boy was injured in the areas, but that the injuries were not of a sexual nature.  Van Renselaer declined to be more specific about this case saying he had not reviewed the autopsy reports.

The toddler was buried during a funeral ceremony Wednesday morning.
