Contact 17 Investigation: Fight leaves local man brain dead

Family and friends of a local man e-mailed and called our newsroom after they say he was brutally beaten in a parking lot on Rosedale Highway. The man's family says their son is now brain dead and they have received little information from police on the case or where the investigation stands.

Bakersfield Police say Josh Robertson got into a fight with four other men. But investigators say no arrests have been made, no charges have been filed, and they will not release the names of the men involved. Meantime, Robertson’s mother says her 27-year-old son is brain dead and won't live much longer.

“No matter what group of kids I go to, everyone one of them has a story about Joshua. It cracks me up. I will laugh and laugh and then I will turn around and cry. My biggest worry right now is that these kids are keeping me going, they are keeping me sane. But when I have to lay my baby down, these kids aren't going to be with me. I don't know what I’m going to do,” the mother said.

Paula Robertson says it's only a matter of days before she allows doctors to disconnect her son from life support. As she is overwhelmed with pain, grief, and anger... the mother says it's the support of her Josh Robertson’s friends that have gotten her through.

“This is like my heart as been ripped out and torn in pieces,” friend Robert Waggoner said.

Robertson's childhood friends, family members, and his softball teammates have poured into waiting rooms at mercy southwest for the last three days.

His mother says the 27-year-old was at the del taco on Rosedale Highway at around 2 a.m. on Friday morning when he got in a fight with at least 3 Cal State Bakersfield wrestlers.

“Josh was defending a young lady that's why he did this and I don't think people know that. I just think they want to say he was 3 times the legal limit of alcohol; he gets out of the car and wants to start a fight,” Robertson’s mother said.

The mother admits Robertson was drunk when the fight happened, but says the other men were harassing a woman at the restaurant and her son tried to help.

Bakersfield police confirms 5 men got into a fight on Friday morning, but detectives won't tell us exactly what happened.

“The investigation is still ongoing. We have identified and interviewed everyone involved. Once the investigation is concluded, we will send it to the DA's office for review,” Detective Mary Degeare of Bakersfield Police.

Bakersfield Police will not confirm or deny whether the men involved attend Cal State Bakersfield. And university officials said they did not know anything about the incident.

These "Wrestlers are the same 4 that beat 2 young men I know about 3 months ago, but they were fortunate to survive! These piles of ---- need to be punished as they will continue doing this!!! Where is the justice???

Why didnt the westlers let one guy just handle josh then IF he couldn't.. pull that guy out and walk away like the bigger person but no they didn't those little PUNK ASSES just saw a drunk 6' foot guy that couldnt defend himself and took advantage! NOW PEOPLE I DO THINK THE WRESTLERS SHOULD TAKE FULL BLAME BECAUSE THEY KILLED JOSH SO THEY CAN ALL ROTH IN JAIL TOGETHER THEIR WAS NO REASON FOR 4 GUYS TO JUMP ON ONE GUY.. THAT WAS DRUNK! OKAY WHO REALLY DOES THAT CRAP?

Maybe people shouldn't get themselves into situations they can't handle? I mean what do you think is gonna happen when you approach a guys window and throw a punch? That hes going to run away? Or try to reason with an INTOXICATED 6'something individual? And some people are saying it should have been one on one? Yeah talk about being fair? Defending a girl behind a speakerphone against a kid more than half his size? Then everyone wants to sit there and say "but they were wrestlers, they know how to fight, they're weight doesn't matter" well obviously josh didn't know all that when he threw the first punch, all he saw were a punch of little KIDS seing as how they are still in their teens in their car being jerks. Some people are commenting about how the wrestlers should have left or stayed in the car? why didn't josh just stay in the car? Obviously the employee he was defending was in no immediate danger, they were being rude in the drive thru? I worked in fast food as a teen and let me tell you, people act like fools ALL the time. It's a horrible tragedy and he obviously didn't deserve this, but the wrestlers don't deserve the full fault here either.

Bakersfield police tend to act as if they have a mission to help families of crimes of this sort. Their lack of caring is why we continue to have unsolved/cold cases! It's embarrassing to look at our officer's and think they really have a mission!

I get sick when I read some of these comments. One guy even has it five on one! A employee getting harrased is even in question. None of you were there and neither was I, so obviously there are two sides being told here. Again, just remember that no one pulled Josh Robertson from his car or physically attacked his friend. Josh's daughter will grow up without a father because he was drunk and started a fight. Interesting name for a softball?

Dont forget josh was standing up for a girl who was being harrassed by those wrestlers, and 140lbs? those guys are trained to scrap, so throw that out the window . and for the tragedy in montion remark josh didnt start it, he was simply sticking up for the girl taking the food orders.

Heat8, we will see once the law is applied. It is certainly a shame that alcohol has once again taken a life. I have the up most sympathy for Josh Robertsons family. I, however, realize that even his death will not change the fact that he broke the law when he initiated an attack on the first 140 pound 20 year. That is what set this tragedy in motion.

Read the paper or watch the news.... Josh has passed! The ONLY people who will pay for this is THEM! Make NO mistake of that!

Heat8, and you know this because you have seen some sort of video the police haven't or maybe you have already spoken to the independent witnesses that were there and gave their accounts to police? The DA will review the case to make sure tha only justified force was used to protect a fellow human and in self defense. But make no mistake. Josh Robertson caused this to happen, he initiated it and if he does survive, which I hope he does, will be prosecuted. It is possible that both parties could be prosecuted.
