Bakersfield woman charged with delivering babies illegally

A Bakersfield woman faces several charges of operating as a midwife without a license.

Brenda Capps is charged with practicing medicine without consent, dispensing dangerous drugs without a license and making a false claim of payment for healthcare.

People from around the United States are showing their support of Capps through online groups and fundraisers. A Utah woman created a petition, with more than 2,000 signatures, asking the California Medical Board to drop the case.

Here in Bakersfield, only a few licensed midwives are in business.
Licensed midwife, LaMonica Bryant, said operating legally is necessary.  "I think it's important to have a license so we have checks and balances. As healthcare professionals we need to have a standard of care and with that licensure it gives you that standard of care, what you're allowed to do, what your scope of practice is, whereas if you're practicing without a license, there are no checks and balances."

Capps' lawyer, David Faulkner, released a statement Tuesday saying, in part, Capps has been dedicated to helping expectant mothers give birth at home and she fully intends to fight the charges.

The best midwives I know are not licensed. A license is not assurance of education, quality care or character and integrity. A license to practice midwifery in CA means you passed a test and documented birth attendance. It does not mean you are more qualified than any other midwife to serve women. The underlying issue though is not whether Brenda Capps is qualified, it is that every mother has sovereign rights over her own biology .....she has the right to choose any midwife or none.

So as long as you pay the government money, it's all great. What's new? Stop calling yourself a midwife and keep on doing what you're doing. You can't be arrested for helping someone have a baby.

Remember these people come from around the world because they have their CIVIL RIGHTS here in this country! They can do what they wish and we get the CIVIL RIGHTS to pay for what they do!

You have to have license to operate a business, to do construction work, to sell real estate. Somehow I think delivering a baby requires a lot more and is more important than other things one must be licensed for.

As I agree with you. I truely believe the the District Attorney's office should be spending their time and our tax dollars making sure that the people who are a real threat to our community stay behind bars and never see the light of day. though out history there has always been midwives and they have not always been licenced, not saying what she did was right but do you really want to see a 60 year old woman behind bars for helping people. I mean really people, we have illegals selling drugs and god knows what else around our schools, and we have nothing better todo but go after a women who has been helping families for 22 years bring new life into this twisted world.

Midwives are practicing a level of medicine and should be required to be licensed in order to show proof of knowledge and skills. Nurse Practitioners, Physician Assistants are licensed. No one should be allowed to put up a sign and call themselves something that they have not proven to be trained for. In addition, licensing assures that malpractice insurance is in place in case of errors during treatment.
