BPD: No crime in Glenwood Gardens death

There was no crime committed when a nurse refused to do CPR on an elderly patient at Glenwood Gardens, a Bakersfield Police investigation has concluded.

Loraine Bayless, 87, died Feb. 26 after collapsing at the Calloway Drive facility.

Staff at Glenwood Gardens called 9-1-1, and a Bakersfield Fire Department dispatcher tried to get staff to perform CPR on the stricken woman.

The nurse refused, citing, she said, a Glenwood Garden policy that says no staff can even attempt CPR. After a recording of the 911 call became public, the incident became a worldwide news story.

Here is the BPD news release, issued at 5:22 p.m. Wednesday.

"On Monday, March 4, 2013, the Bakersfield Police Department initiated a preliminary investigation involving Lorraine Bayless, a resident of Glenwood Gardens, located at 350 Calloway Drive,

"The investigation focused specifically on the events of Tuesday, February 26, 2013, at approximately 11:06 a.m. The purpose of this investigation was to determine if there were any criminal violations, as defined by the California Penal Code, pertaining to the death of Bayless.

"A thorough review was conducted of all the facts surrounding the case. The investigation revealed that no criminal statutes had been violated. As of Wednesday March 6, 2013, the Bakersfield Police Department has concluded its investigation and will not be filing any any criminal charges against any of the individuals involved in the case."

It's also not a crime to not intervene when you see someone being beat up, or when someone is choking on food and you don't do the Heimlich manuever, or when someone falls and you just stand there looking like an idiot. But not being a crime doesn't mean it isn't despicable act.
