17 News Investigation: Local company owed money from "Direct Buy"

Another person has come forward to say she's owed money from "Direct Buy."
The local home furnishing store, that promises members "insider" prices, suddenly closed up shop.

Tammy Borda is the General Manager of Rand Employment Solutions. She says the owners of the local "Direct Buy" hired one of her workers, then failed to pay the bill.

A moving van was outside the "Direct Buy" store in southwest Bakersfield on Thursday.
Inside the store, you could see mail and checks piled up on the floor. The workers say they were hired by a bankruptcy court out of New York.

Borda and Brian Bezdek are trying to get back money, they say, owners John Fitzpatrick and Larry Fleck, owe them.

Bezdek and his wife paid $5,000 for a ten-year membership, only to have the store close two weeks later. They got some of it back, but are still out to close $1,500.
Borda says her company is owed close to $1,900.

"I had direct meetings with Larry Fleck. John Fitzpatrick, being the principal, wasn't always there. He was either in L.A., sometimes here, but I'd miss him," said Borda. "So Larry Fleck and I sat down. He agreed that the invoices I showed him and the documentation, was all owed and he'd get back to me and see what we could do and it just deteriorated from that point on."

Borda filed a lawsuit against the owners, but she hasn't been able to serve them with papers because she can't find them. Neither could we. Their last known address was in Mission Viejo.

One website we found has 116 pages of complaints from people warning others not to do business with "Direct Buy."

Does anyone know where you can find the 3 day cancellation period for new members because I was told by someone in the corporate office that there is no such thing even though I have found interviews dating back from 2007 and 2009 that clearly say there is such a thing. It is no where in my contract but when we asked him our sales person told us that as new members we could cancel within the first 3 days.

I knew directbuy of bakersfield very well as well as the owners, John was a great man that knew how to talk to people and make them understand many things, larry however, would judge people at the first glance and decide they were not worth his time to even put them through the tours, he always spoke to people as if he were interogating them,I recall even seeing the service member pour alittle alchohol in her coffee one morning, no wonder she offered poor customer service.as far as shopping online not all items are available online,the company overall has good intensions and has saved alot of families money on their home remodeling, but the down side was they pay so much money for the membership to be treated like crap from the service team, such as avoiding phone calls and hiding when certain members would walk through the door.I think the biggest mistake was for John to partner with Larry, he was the reason why the company went under, that man has no communication skills or the knowledge that it takes to run a business.

I too am a former employee and Service Manager of DirectBuy of Bakersfield, ranked not only as a five star club nationwide but also in the top 5 customer service performing clubs overall often. This story is beyond one-sided and am quite shocked that KGET would cover a story in such a manner. If anyone bothered to look up DirectBuy of Bakersfield up on the BBB website (http://www.bbb.org/central-california/business-reviews/furniture-retail/direct-buy-of-bakersfield-in-bakersfield-ca-89006486), you would find that this business is not a "horrible monster" as the media is portraying it to be. It has had less than ONE issue/complaint in every category. Franchises are franchises, some close, some remain open, it's the unfortunate fact of life in this economy. As Marvin stated, members are still able to purchase thousands of products via the DB Members website, visit any of the other clubs nationwide, OR call the 800 number where customer service reps will be more than happy to assist you with your shopping needs. It's unfortunate that this club closed as it was my home for me as well as many other great individuals that cared passionately in assisting members with their remodel/ project/next dream purchase, etc., and YES folks, the SAVINGS, SERVICE and SELECTION is VERY REAL, I lived and breathed it every day for a few years. What most non-members don't know is that EVERY new member has the right to cancel their membership within 3 business days of enrollment, this isn't a gimmick or a scam, it's right on the contract. If this wasn't done so within this alotted time, then consider that contract like any other contract you ever sign, permanent. This is by definition what a contract is. DirectBuy as a whole has made hundreds of thousands of families happy for over 38 YEARS. Please cover the entire story next time out of respect for those who you are slandering along the way, enjoy your membership, and start this new year off positively.

Thanks, Marvin, for posting this. I know there are two sides to every story, and while I confess I don't really know what happened with the Direct Buy store in Bakersfield, I have to say that I've been a very satisfied customer. We joined the Direct Buy in Thousand Oaks, then transferred our membership home base to Bakersfield afte moving to Kern county 2 years ago. We have purchased MANY things from DB Bakersfield, and never had a problem. You, Marvin, were always so great and helpful to us, and so were the people who helped us inside the store. I hope everything gets straightened out soon for everyone involved. Being a Direct Buy member may not be for everyone, but we love it, will continue to use it, and have literally saved thousands of dollars on home improvement; membership paid for itself in 6 months.

Well I know we were invited for a free tour of Direct Buy & treated like dirt.Was told their store not for us. We wouldn't have joined anyway. I do not beleive in membership stores. Why pay them to go in buy thier stuff so they can make a profit!I know of people they have screwed

I am the former Receiving Manager of DirectBuy of Bakersfield and I can tell you that this "investigation" is misleading and badly one sided. For one, there is no such thing as a ten year membership, it's a two year. All members are still able to make purchases (online or through the Fresno or Burbank clubs) and pick up their orders right here in Bakersfield at a storage & delivery service that our Corp. headquarters made arrangements with. NO ONE has been screwed out of anything, so get your story right. As for not being able to find John or Larry...you obviously haven't put forth much effort as they are both listed and their numbers are still working. I have been in contact with both. It's a sad day when "reporters" jump to conclusions and only take the time to tell one side. If the "reporter" that covered this one sided farse would like to at least sound a bit more level in his/her reporting of the facts he/she may contact me at marvalden@yahoo.com
