No charges to be filed in death of man who was found unresponsive outside Rosedale home last summer

DA's office: Evidence shows man was killed in self defense

BAKERSFIELD, Calif. - The Kern County District Attorney's Office said no charges will be filed in the death of a man who was strangled outside a home in Rosedale following a party last summer.

The Kern County Coroner's Office released the cause of death of John Eric Maltby, II, on Monday while the District Attorney's Office said it would not file charges because evidence showed Maltby was killed in self-defense.

Maltby, 32, of Bakersfield, was strangled at a home on Michelle Avenue near Hageman Road and Verdugo Lane, according to coroner's office. The death was ruled a homicide.

Sheriff's deputies were dispatched to the home on July 16 for report of a peace disturbance.  Maltby was in a fight with several people as the party was wrapping up around 1:30 a.m., according to KCSO.

When deputies arrived, they found Maltby unresponsive in the front of the home, according to KCSO.
