New state fire prevention fee creating controversy

Thousands of Kern County homeowners will have to pay a new fire prevention fee of up to $150 a year. The invoices are showing up in mailboxes across the county.

According to Cal FIRE, the money will help prevent future wildfires. But, some local homeowners think the new fee is unfair.

Cal FIRE says the fee will pay for fire prevention services across more than 31 million acres of California and a little over a million acres here in Kern County.

Willard and Eilene Vanfossen have called Lake Isabella home for 30 years. "I want to be safe. I want my neighbors to be safe," explained Eilene Vanfossen.

26,500 homeowners in mostly rural Kern County are being hit with the new fire prevention fee.

"If it went to the proper place, I wouldn't mind paying for it. But, when someone goes out here and deliberately sets the fire, I'm not sure I want to pay for it," said Eilene Vanfossen.

The new charge will generate about $85 million a year for the State Department of Forestry and Fire Protection, also known as Cal FIRE.

The budget for Cal FIRE has been slashed by $80 million this year.

"This new fee helps provide a stable funding source for public safety for services that might otherwise be cut," said Daniel Berlant, Spokesman for Cal FIRE.

"Fire prevention is what actually helps prevent major wildfires," he said.

According to Berlant, every year, it costs more and more money to fight fires in our state.

"We understand these are some tough times for everybody, but we understand as well how vital these services are," noted Berlant.

There will be no new services in exchange for the fee. Assemblymember Shannon Grove is calling the new fee, illegal and unconstitutional.

"They passed it as a fee, but I believe it is a tax. It did not receive two-thirds vote requirement, so I believe it's unconstitutional and unfair," said Grove, (R) Bakersfield.

Some rural homeowners say the state is trying to make up for budget shortfalls.

"Most of the taxes that we have are unconstitutional. So what's the big deal?" said Steven Friend. "It's just part of living in modern America. The thieves get rich and the working schmuck gets fleeced like he's a little sheep."

Shannon Grove said you can sign up to fight the fee at www.firetaxprotest.org and join the class-action lawsuit.

Invoices will continue to arrive in mailboxes over the next few weeks. You have 30 days to pay. You will face penalties and fines if you are late.

Dream Act=paid for by taxpayers fire protection= paid for by taxpayers and fees American Citizens we are being bled to death because they want to give to others and take from us.

No more taxes!!! I am a middle class guy, with a wife and two kids and a morgage. I am trying to live the "American Dream" but i am getting phased out here. Our lawmakers are killing this dream for us and our children. This fee is unconstituional and needs to be repeled asap. I have worked with CALFIRE on a couple of wildfires and they are not going to give you any special coverage for your property. They already getting millions of dollars from our state and from the federal governmenment. These firemen are getting paid thousands of dollars around the clock and getting fed steak dinners. I know because ive been there. I am thankful for the firemen but their scheduels needs to change to save taxpayer money. Do not pay this tax and write a letter to your lawmakers.

Wesobako you might like to recheck with your insurance company on that one. Like Murp said, if there is a added fee in a fire zone and you do not pay this fee then in most cases your insurance will not pay your claim when it burns down, call your carrier before you decide not to pay!

Fee ='s tax. We already pay fire fighters through taxes! Why more taxes? More people work for the state, less money in the pot from contributing tax dollars. Teachers, Police, Corrections, Firefighters, DMV workers. Ect... There isn't money to pay for fighting fires. Let my house burn and insurance will cover it. I'll pay the yard and a half. I don't feel sorry for firefighters. Maybe if they spent time fighting fires and not showing up for every heart attack, kidney stone and nose bleed call from 911 we wouldn't worry about our stuff burning, right! How can we get the state to budget our money? Stop wasting it through bs. Cal fire agency, we don't need him we need a fire fighter! Or two on his salary! Not on mine!

Let's see, what do I already pay for living in what the State calls a fire zone...I already have been paying a tax for living in a fire zone. Now AS of this year my homeowners insurance increased by 40%. My earthquake insurance went up. I am now required by my insurance company to clear all brush 1000 ft. around my structure. I have to have all tree branches cut atleast 100 ft. away from the roof line of my home in order for them to renew my policy. That included applying for a permit and getting approval from the State for cutting major branches of protected oak trees. My local fire dept. came out and demanded that I do additional clearance beyond the 1000 ft (yes that's 1000 ft, not 100 ft) demanded by my insurance company. They also required me to remove 20 trees because they would easily burn in a fire situation. Forget that they were more then 1000 ft from the structure. Total increased cost to me this year over $9,000 (between insurance increases and clearance costs). Who has that kind of money just sitting around. Now they are sending me another 'fee' for fire protection, yet I will never see any preventative services from any of that 'fee' because I have already been required to do work on my own dime. What a bunch of baloney. This is what you get when you have a one party politial control envronment in CA. We the taxpayers of CA are the chumps who keep feeing the poliicians kitty for their special programs that help any and all who won't help themselves.

Sure a person might have insurance on their home but you might like to check that one out. You might just find that by not paying this fee your insurance will not cover a fire! Then if these people wish not to pay they can get a tractor and plow around their homes, install a fire sprinkler system and a backup water system when the power goes down which would cost them thousands of dollars but that is up to them because the fire department would not be allowed to fight their fire for them! Good luck!

I'm guessing that the $80 million that was cut from CalFire's budget has always been funded by the taxpayers of this state. So the governor slashes the funding to CalFire, and they respond by charging rural residents a new "fee". Plaintiffs in a class-action lawsuit will quickly be able to show that CalFire has always been funded by their taxes, and therefore, this is absolutely an illegal tax. Oh yeah, Moonbeam and CalFire are gonna lose this one in court, big time.

1000s lossing there homes to forclose.no new jobs.if my homes burn to the ground i have insurance.they can stick this up the rear.everyone needs to protest this now

This is just another case of the Ca. State Assembly getting further out of control. Here's another fun one. As of Sept. 15 there is a recycling and recovery fee on every bucket of paint that is sold. It equates to $0.75 per gallon. There is no recycling paint cans. You let them dry then throw them away. There will be no recycling after the fee. Just a fee. We are seeing all of these new fees because our snake of a governor cant raise taxes without a proper vote but he can raise and enact new fees without one. It's hust a tax with a new name...still a tax.
