Neighbors afraid of pit bull in yard of vacant home

Neighbors are scared to leave their homes in one southwest Bakersfield neighborhood, where a pit bull is living outside a vacant home. 17 News spoke with people who think it could attack someone, but the owner says his dog is harmless.

Three-year-old Chocolate has neighbors on alert. “It scares the living hell outta me,” said Jerry Yopp. “We were told his head measures 29 inches around. He is very, very strong,” he said.

The dog lives alone outside an empty home on a street with almost a dozen kids. “That dog could get one of them and be dead in one bite,” explained Yopp.

“My youngest is five. It's just a snack for him,” said Julie Willey.

They want the red pit bull evicted. Neighbors said their biggest concern is a pair of boards missing on the backyard fence. They say the pit bull can now get into the front yard, where the fence is much lower.

“It wouldn't take him but a little hop to come over that little wrought iron fence out front, and he will attack anybody that's got their back to the dog. He knows he's protecting the back side of his house,” said Yopp.

Victor Escamilla told 17 News he got Chocolate for protection after, he said, thieves stole everything in his home that's up for sale.

But, neighbors don't believe him, and now, Bakersfield City Animal Control is caught in the middle.

“This is not the first time we've spoke to them. I think it's the seventh time. They are well aware of the dog,” said Escamilla.

Escamilla said the dog is harmless. “He only barks at people he doesn't know. He’s a very playful dog,” he continued.

Animal Control officers came out to the home but left without Chocolate. State law requires the officers to give the owner 48 hours to respond to the complaints or the dog could be seized.

“The City of Bakersfield and Bakersfield City Animal Control needs to make sure that the animal is kept safe and make sure it has enough food and water and is kept within the enclosed area, which is necessary for the safety of the community as well,” said Michaela Beard, Bakersfield Police Department.

If the dog is still being fed and waterd than whats everyones problem. Everyone thats complaining about this dog know nothing about animals.These dogs dont just attack for no reason,someone has abused or miss treated a animal to make it do things that normally wouldnt do. I have two bull dogs at my house now and love them more now than years ago because i live with them and trust them to protect my home and even sleep in the same bed. Remember its not the dogs fault its the people that give them a bad rap. All i know is i feel no security system protects my family like my two best pals can.

Jewels &HeidenspassYes dog should be taken where it is confinded & supervised. The owner know's nothing about the dog. He bought it for a watch dog. For dogs safety & peoples it needs to go

Well, unfortunately pit bulls do have a bad reputation. The owner of the dog is being negligent for keeping him at the abandoned house. @Jewels, your neighbors know your dog. These neighbors don't know this dog. The owner brought the dog in when the abandoned house was broken into. Who knows how this dog behaves around other people and other dogs.

What is getting to me about all of the comments here so far is the stereotyping of this dog just because he's a pitbull. I agree that the fence should be fixed. I also agree that that Chocolate shouldn't be left alone for extended periods of time. That's because they very social dogs and he is probably pretty lonely. I myself own an American Staffordshire Terrier and she's a wonderful dog. All of my neighbor's just love her and she even loves cats, and gets along with other dogs. She barks at them all of the time, but would never hurt anyone. She's just very vocal. She's smart and funny and just a good dog. To say that a dog will be a bad dog because of it's breed is just like saying a person is bad because of the color of their skin. Remember: there are no bad dogs. Only bad owners. End BSL

So, what you're saying is even though the dog has not hurt anyone, has not bitten anyone, if being fed and watered by the owner, is enclosed in a fenced yard, and no laws have been or are being broken, the dog should be siezed anyway? Because of other people's opinions? Even though NOTHING has happened and it's all a bunch of what-ifs... Wow, ok. The owner should, at least secure the fences and ensure they cannot be escaped but other than that nothing illegal is going on. I can't wait to call the police on that guy that walks down our street every day. He's not doing anything, but he's not at home, so he must be homeless. And he's just walking around and COULD do something. I mean, you never know right? He's probably a drug addict and felon. I think I'll have him arrested. Just in case. Since thats ok, and we can do that kind of stuff now.

@RVLADY, your absolutely right, technically the owner did abandon his dog. When his dog does injure or kill someone, I hope the family sues the h-e double hockey sticks out of that negligent jerk.

About two weeks ago, I was walking my dog in the neighborhood and a pitbull ran around the corner and went straight for my dog. My dog weighs 13 pounds, this pitbull was easily 60+. I was holding my dog above my head, as the dog jumped on me to get to my dog. Someone stopped and helped me get away, but the the owners of the pitbull told me "he was just trying to play with my dog". I don't blame those neighbors, I would be terrified as well!

Animal control should take dog. If dog left alone his owner has no control over it. You going to wait until someone is hurt or killed. Also take dog for dogs sake!
