KCSO: Homeowner shoots robbery suspect

People living in one east Bakersfield neighborhood are anxious and on alert after Kern County Sheriff's deputies say a homeowner shot a robbery suspect. Investigators say it happened just before 11:00 a.m. Tuesday in the 5300 block of East Brundage Lane, and the suspect may not have been alone.

Deputies say 26-year-old Arturo Jose Luis Estrada, removed a screen and broke through a window to get inside the home. He was taken to the hospital after he was shot.

People who live nearby say they think would-be criminals have been casing their neighborhood.

Mary Leal says she is the aunt of the man who lives in the house where the shooting happened and she lives just down the road. "I feel like I'm in danger right now," she said.

Deputies say the homeowner called saying someone had broken into his house through a window and he shot him.

"When deputies got on scene they located the suspect. He had fled the residence on foot and had run about a half a block west of where they are standing and had collapsed. He was taken into custody," said Ray Pruitt, Kern County Sheriff's Department.

Deputies say Estrada was shot at least twice. He was taken to Kern Medical Center where his injuries are described as non life-threatening.

"We do believe there was possibly a second suspect involved who was to the front of the residence when the one suspect forced entry," said Pruitt.

Police believe that second person, a woman, ran away in the commotion of the shooting. And, it's leaving people like Mary, scared, since she's heard of other criminals in her neighborhood looking for opportunities.

"They are knocking on the doors to see if people are home. So, I've been hearing that that is what's been happening," said Leal. "Things are just starting to happen. I don't know if it's the Christmas or people getting out of jail. I don't know. I just don't know."

Deputies say it's too soon to say if the homeowner broke any laws. Estrada remains in police custody at the hospital and will be booked into the Kern County Jail for first degree robbery when he's released. They are still looking for the woman they believe ran from the scene.

@murph56 I agree with you. If burglars are in your, house shoot them dead. We do not need to waste taxpayers money on scumbags.

RV you better read up on the laws before shot! Once they break in shot them dead, just make sure they are dead or you are going to support them for life! Outside they better be shooting at you before you shot back or you're going to jail! If they were in the house and ran outside again if you shot you're going to jail! The police look at it, if they are outside they are no longer a danger to you unless they are shooting at you!So make sure you shot them dead and make sure their in the house before the police show up and if you can put a weapon in their hand!

kern661, you need to learn what a burglary is. And I have not heard or read any facts that makes this more than a burglary.

@dr999 do you know the difference? Robbery involves force or fear. Burg is just theft from a locked dwelling without force or fear.

Back in 1957, a woman shot a burglar in her home. The problem was, before the burglar died he was able to run toward the front door and when he fell he landed outside of the front door he had broken down to get in. When the BPD arrived the first officer told the woman to make sure she drug the burglar back into the house so that it did not appear that he had not gotten into the house when she shot or she could be charged for the killing. He then went back to his patrol car to talk with is partner and when he returned, the burglar was nicly placed inside the home. No charges against the homeowner. To this day I share that Officers statement with every friend I have because that Officer help my mother from possibly facing a trial and jail for protecting her home, self and children from a criminal.

DR999, you're right only the D.A. can bring charges against the person for protecting his home. But Estrada can sue for pain and suffering. That's why the homeowner should have practiced gun control and placed the lead more effectively.

Betty401, the suspect's family can't press charges. Only the D.A.'s office can file charges.

Good for this person for protecting his life and property! I sure hope we don't see the family of the suspect trying to press charges! The owner obviously feared for his life and I don't believe what he did was wrong, but yet, The law can seriously be so twisted with protecting these criminals!

He was in mans home! Homeowner had right to shoot him. They break in my house when I'm home they will get shot!
