It is a problem Delano police say was out of control in their city - yard sales.  However, residents in Delano are now fighting an ordinance that limits when they can have yard sales.

Code Enforcement in the city of Delano says if residents don't abide by the ordinance of just four yard sales per year, on designated days, they can face a fine of up to $500.

In these tough times, yard sales are a way for people to make extra money. However, in the past two years many residents in Delano have come forth, saying too many yard sales were becoming more like businesses. 

"There's so many people that take advantage of it. They don't abide by the laws. It is just not right to those that do abide by the laws," said one resident.

Delano police say an ordinance was passed by the city in September 2011 after numerous complaints.

"About a year and a half ago, the city council had been receiving numerous complaints from the citizens of the community regarding some folks using garage sales as businesses. The city council directed staff to go ahead and look at that and come back with recommendations," said Delano Police Chief Mark DeRosia.

That's when the city decided to pass an ordinance that restricts the amount of yard sales.  The ordinance limits residents to holding four yard sales per year, during these specific times: the third weekend of January, April, July, and October. If you hold a yard sale on another day you could be fined.

Some residents feel this is a good thing and in the best interest of the city.  It's also important for residents to understand they must obtain permits before holding a yard sale.

The city of Delano will discuss the issue at a city council meeting May 7th.

We have restrictions here in Bakersfield but the office is closed on weekends and they have to come out and see the yard sale when you call to ticket them. I have people on my block that have a yard sale every weekend. I have one that have had one seven days a week for the last three weeks police drive by everday and nothing.
