Looks like someone on here learned civil law out of a box of cracker jacks! The businesses are affected by the actions of the city so that does make them liable to the property owners and businesses! But winning a suit here in Kern forget it!

Yes the owners of the property will sue the city but in this county good luck!Sure the city is liable for the lost to the businesses but no court in this county will see it that way!

robtalan1, are you serious? The City isn't liable because the property owner can't lease the property after the current leaser breaks their lease. Where did you learn civil law?

Hey Moo, it's time you renegotiated your lease. If traffic drops 20% rent should drop too. The owner must understand you need to make a living. If the owner was firm, I would break the lease and move. If he can't re-lease the property then the owner can sue the City for the loss. If I were the owner I would be doing anything to keep my tenant, especially if he has a profitable going concern. That's only an opinion, I'm not giving Real Estate advice.

Why would you sign a 10 year lease at this location? It was very easy to see that this location would be greatly impacted, once this construction had started.

Moo Creamery has good ice cream. But their lunchtime food is terrible.
