17 News Investigation: Corrections officer arrested, accused of framing inmate

A corrections officer at Kern Valley State Prison, who was left battered and bruised by an inmate, now faces criminal charges.

That's because state investigators say he actually agreed to the fight, then tried to frame the inmate to avoid getting in trouble. But, that inmate refused to go down alone, saying he could remain in prison for life for a third strike conviction.

41-year-old Christopher Cruse pleaded not guilty late last month to six felony charges, including filing a false peace officer's report.

Prosecutors are also charging Cruse with filing false insurance claims after he went out on stress leave following the fight.

As Delano Judge Robert Tafoya read off a laundry list of charges, Cruse scribbled copious notes and then entered his plea... not guilty.

Cruse, once charged with protecting and serving those at Kern Valley State Prison, could soon himself serve time behind bars on charges he accepted a challenge to  fight an inmate.

Investigators say it happened in late February 2011 in the hard yard of Facility D.

Documents indicate inmate Frances Allen argued for a short time with Cruse before the corrections officer challenged the inmate to a fight. A watch tower guard let the two into the yard, where they squared off and began throwing blows. But, the fight didn't go as the officer planned and soon he found himself on the ground being pummeled by the inmate.

A second corrections officer who is only identified in reports as "Murphy" had followed the two to the yard. Officer Murphy ordered inmate Allen to stop. But, when he didn't, Officer Murphy struck inmate Allen in the thigh with a baton and placed him in handcuffs.

All three agreed the fight was over, but the officers soon realized others had seen what had happened and knew too much. So investigators say Cruse and Murphy hatched a plot to walk Allen through a prison hallway and pretend the inmate assaulted Cruse there.

The officers tried to get Allen to go along with the story, but he refused, saying it could mean a third strike conviction for him and a life sentence.

But, the officers went ahead with the plan, tackling Allen in an empty hallway and reporting Allen had attacked Cruse without provocation.

A 300-page internal affairs report obtained by 17 News, contains large blacked out areas, usually involving names of officers on duty that day. The documents paint a picture of an initial coverup, in which a sergeant ordered an officer to scrub Officer Cruse's blood off the yard with a brush and bleach. Another lieutenant said her report of the incident was erased from the prison computer.

Inmate Allen received an administrative penalty that added 90 days to his term, but he has not been charged criminally for the fight.

Cruse hasn't been charged for the fight either, but faces a slew of felonies for filing false reports after he went on stress leave.

An ex-girlfriend told Internal Affairs investigators Cruse bragged at the time he was making more on disability than he did while working.

Cruse is out of custody on a $60,000 bond. No one answered the phone at the number listed for his current address.

He said during last month's hearing that he's in the process of hiring a defense attorney.

I hope every "Opresser" (correctional officer) that harmed an incarcernated I'm pretty sure they will burn in hell. The thing is in the USA there is LAW's how a prisoner is to be treated. But there is not one Prison/fed in all the states that do. Most of them are loweducated (officers) and for some reason they have a adrenalin kick to humiliate and look away when someone seriously is getting hurt. You cant say everyone in prison uneducated, most of them are unfortunated people, maybe even born into crime, you can only blame the society. And no shit( excuse my language) that the prisons is about to explode. For a itty bitty crime they give them 20-30 years. I mean didnt Ronald Reagan think about that and the cost, and what about a second chance????? Ever thought about why a pedo get less years???? yes some are very educated and right had or still got a higher post in the government, you country is full of corrupt people and the promised land died long time ago. A proud and happy swede, I pray for justice

Maybe he has a clean record, cuz he never got caught!!! I have heard the c/o's doing this, before this story happened! The other c/o's are Framing him ? I do not think so!!! I get my info, first hand,. Not hear say, my sweetie has been down 28 years ....the c/o's that are not right, and disrespectful , I seen it my self...... My own eyes, they made me lie about something, and said if I didn't lie for them, he would put my man in the HOLE..... so don't you tell me they are all on the straight and narrow.... I know BETTER. MY GUY IS GOOD, AND TOTAL RESPECTFUL, I know it's the cops against the inmates, and in their order, but those c/o's are rude, and twisted, and lie, probably on a daily bases,., I was in the court room with that c/o ., if I would have known why he was there, I for sure would have punched him in his face.....hope ALL the bad ones, rot in HELL.......and no,they are not all bad, some are respectful ,....oh, yea, three c/o's got fired ! And two suspended !!! No, he didn't do nothing...........I know too much huh!!! How do you like me now !!! Hope your friend gets the max....and then everything else he deserves....... Karma is a b****.......

Melbo: I think the real stupidity you are referring to is what landed your beloved inmate in jail in the first place. Tylermade: And I can say that I have never lived off of the system, I am glad that you can too. I also didn't say that anyone was uneducated, in fact there are some very educated people incarcerated as well. What I did say, however, is that some very poor choices, including some very awful, horrible, disgusting choices, landed them in jail---so why should I pity them??? I also don't agree that they are treated poorly. Free food, beds, tv, etc....sounds a lot better than most of our citizens live. As for poor medical treatment?? What a joke! They get any treatment that they need, which again is more than our Free law-abiding citizens give. If you don't believe me...drive down Truxtun at any given time and see them walking the inmates in for dialysis. They receive radiation, chemotherapy, transplants, and much more. Even death row inmates receive this same care. I'm not really sure where you got your info??

What is a "Prison Guard"? Last time I checked they're title is Correctional Officer. You don't call a cop on the street a "Pig" so why the slang? And FYI, EVERY job has corrupt people, Law Enforcement, doctors, fire fighters, even the manager at Wal-Mart, because people are PEOPLE. Their title doesn't mean anything, no matter how much school they have or how many certificates they have on the wall. Just saying..

I have known this Officer personally for over 28 years and know for a fact he has a spotless record, don't believe everything you HEAR or read in the media as the truth, they hype up stories with headlines of charges that dont exist. Of course the "Inmate" is going to say whatever he can to keep his butt off the line, and everyone else involved that did not follow protocol correctly and inadvertently made it look real bad and sadly lost their jobs, Things are not always as they "APPEAR" in the media....It clearly states in the inmates testimony that Cruse never touched him, the inmate jumped him when his back was turned...IMO...This is just an attempt by the Insurance companies to regain funds..period!

Really, Did you know that the majority of drugs brought into a prison are brought in by the guards. And yes there are some low lifes in prison but there are also some descent people who were 'caught' and have learned their lesson. What people fail to realize is that they are still human. Animals are treated better. In fact, if you treat an animal the way most prisoners are treated you would be arrested for animal cruelty. And just because we have family or loved ones that are incarcerated does not make us who visit scum!!! Have you ever talked to someone or visited someone incarcerated. I guess that you think those that visit are uneducated and low lifes too. Well I hate to disappoint you but I am educated and a professional. I obtained my degrees, yes I went to graduate school and paid for it all by myself, while my husband has been incarcerated over the last 20 years and raised my children. Never been on welfare or lived off the system. Can you say the same?
