17 News Investigation: Internet sweepstakes cafes

In Kern County, there are eight internet sweepstakes cafés, which are sometimes referred to simply as internet cafés. However, some suspect what's for sale is a chance to win money, which would make them casinos.

The District Attorney's office says it is currently investigating four of them in Kern County and working to shut them down. 17 News went inside one of the cafés called 'Online Fun,' which is located behind Mercado Latino on Edison Highway in Bakersfield.

Inside the business, customers are able to purchase time on computers, which gives them free internet access and the option of playing games of chance. Erica Arias, Manager of Online Fun, says it is simply an internet service which they provide to their customers.

"You log in. You can either browse the internet, go on Facebook, MySpace, pay your bills or you can play games. It is not a slot machine or a casino in any way. You are not gambling," she said.

However, Deputy District Attorney Greg Pulskamp says places like this constitute gambling. "The bottom line is if somebody is paying money for the chance to win additional money by a purely random process, then that is gambling."

Daisy Lugo of Bakersfield says she comes to the center because she doesn't have internet at home, and it gives her a chance to catch up on e-mail.

"It's like when you are on Facebook at home, you can play games too that you need to use a credit card to buy credits, so it is basically the same thing," she said.

The District Attorney's office advises anyone who is considering opening a business like this to understand the liability. "It would be wise to advise anybody out there that is considering opening this business along these lines to realize that they are exposing themselves to criminal and/or civil liability."

The manager of Online Fun said they have been open for three weeks and haven't had any major problems, partly because they do not allow or serve alcohol.

It's funny how you say that the door to these places are shut down and that you will call the police on anyone entering because I work at one. We have not shut our doors for one single day. Each internet cafe is being investigated on their own case by case basis. So before you go running your mouth about all of them you should do your research around town. Your arrogance sickens me!

When the Doors reopen what will you say then...? Kern County seizes to amaze me by its backwoods, bigotry and judgmental train of thought... You guys are more worried about someone who is making a life for him and his family, and owning his own business instead of pushing to lower the gang violence, the drive by shootings we hear of every day, the Child molesters and child abuse..We have bigger problems is society then something as this.. Or what about putting all of your thoughtful energy to use at a local charity or a good cause... NO instead you are too worried about the minor things... GIVE IT UP TO SOME OF THE "GREAT" PEOPLE WE HAVE IN KERN COUNTY.. No wonder no one can make a life for themselves in this god forsaken town..

There legal in Ca because they operate like McDonald's? What are you a pre school drop out? In now way are this the same. Anyway the doors are closed and if they let one person in I will call to have an officer there to have everyone in the place arrested, read to law, that is if you can read!

These places are legal in California because they operate the same way McDonald's Monopoly sweepstakes pull tabs work on soda cups. Each time you buy phone/internet time you are given an electronic game piece to reveal your prize. You can see the ticket number at the bottom of the screen. Because there are a set number of prizes, just like fast food promotional games, it is not a random game of chance. Such as a slot machine with a "RNG" chip which gives random numbers. You actually are buying internet time or phone time which can be used at the location. The screens look like slot or keno displays, but they are just graphic representations of the winning amount on the ticket number. California would have to change the Law and current games at fast food businesses would also be illegal in that case. Many of the businesses already have attorneys who have verified that it is lawful. So the DA better have their ducks in a row.

In a rush just trying to vent.. My apologies for the horrific amount of typos... I currently work at a sweepstakes cafe and it is pure entertainment.. Nothing different then going to the bar for a few drink and some socializing.. As was said in the article, we do play games on Facebook and other social medias where credit may be purchase... They are harmless, and you would think with the way the economy is now a day they would just up the taxes and bank off of them... People have far too much free time on their hands, plus This good ol' boy red neck of a town always has to harass someone just trying to make something for themselves and their families.. Give me a damn break...
